Men, women are equal in Islam'by Jacqueline Ann Surin(the sun,sept12)
PETALING JAYA: Islam accords women equal rights with men, and like other religions, promote women's empowerment and emancipation, Chief Judge of Malaya Tan Sri Siti Norma Yaakob said.
"Like many Muslims, I do not believe that Islam, which abhors injustices, treats women any less than it treats men.
"Women, like men, are vice-regents on earth; equal in the eyes of Allah, and it is our collective responsibility to ensure that principles of justice and equality are reflected in our laws," she said today (Aug 28, 2006) when opening the three-day International Conference on Legislations and Mechanisms to Promote Gender Equality.
Siti Norma said she felt compelled to say a few words about Islam "to dispel misconceptions which are prevalent when a religion is politicised to suit various agenda".
The conference, jointly organised by Penang-based Women's Centre for Change (WCC) and the international solidarity network of Women Living Under Muslim Laws, is a meeting of international experts to compare and discuss gender equality legislation and mechanisms.
Earlier, Siti Norma said unjust laws should be dismantled.
"I believe that a law that fails to produce justice is a law that should be dispelled not only from the statute books but also, as we say in common law, from the breast of the judges."
She also said there was a need for Malaysian domestic laws to be formulated in tandem with international treaties that Malaysia is party to.
"It is well established that provisions of an international treaty to which Malaysia is a party do not form part of Malaysian law unless they are validly incorporated into our domestic law by statute.
"This principle has its basis in the separation of powers between the executive and the legislative arms of government," she noted.
Malaysia ratified the Convention on the Elimination of All Forms of Discrimination against Women (CEDAW) in 1995. In 2001, the government amended Article 8 of the Federal Constitution to prohibit gender discrimination.
However, at the country's first review by the CEDAW committee at the United Nations in May (2006), Malaysia was told it needed to formulate laws to ensure the treaty's principles were effectively established and implemented domestically.
WCC vice-president Zarizana Abdul Aziz said a draft Gender Discrimination Act would be tabled at the conference and would eventually be submitted to government next year (2007) after consultation with other groups.
"The draft bill's objective is to prohibit gender discrimination and to promote gender equality," she told reporters, adding that the bill was being formulated within the Constitutional framework.
Among others, Zarizana said the bill would propose the setting up of a gender commission to promote and advise government on gender equality, and a tribunal to receive complaints and provide redress.
"A gender discrimination law would also create an acceptable standard for gender equality and provide the test for other laws," she said.
Zarizana added that while the Constitution prohibits gender discrimination, it does not set up the mechanism by which discrimination can be prohibited as evidenced by the Beatrice Fernandez case in which the former Malaysia Airlines System stewardess was terminated following a pregnancy and was unable to seek legal recourse.
She said the government would also be able to fully realise its CEDAW obligations if it adopted such a bill.

PETALING JAYA: An independent gender discrimination commission would be able to review all laws and policies in Malaysia and address those which discriminate against women.
Setting up such a commission with such a role is one of the clauses in the proposed Gender Discrimination Act which was presented today (Aug 29, 2006) at the International Conference on Mechanisms and Legislation to Promote and Protect Gender Equality.
Women's Centre for Change (WCC) vice-president Zarizana Abdul Aziz said among others, the commission would monitor and review laws and their implementation to identify areas which result in discrimination.
The commission could also advice and assist the government in formulating legislation and administrative directives and procedures, and recommend the measures to be taken to prohibit gender discrimination and promote gender equality.
"The commission can also receive, investigate and conciliate complaints in relation to gender discrimination," she said.
Last Friday (Aug 25, 2006), at the launch of the National Women's Day celebrations, Deputy Prime Minister Datuk Seri Najib Abdul Razak said the Cabinet had approved a Women, Family and Community Development Ministry proposal to review laws and policies which do not treat women equally.
Zarizana said she welcomed a government audit but noted that these laws had already been identified in a women's groups' 1985 memorandum to the government.
"Reviewing the laws alone is also insufficient because a woman can be discriminated against by other things apart from the law," she said.
Apart from setting up a commission, the proposed bill also seeks to set up a tribunal that can hold quasi-legal hearings to provide redress when discrimination occurs.
The bill also seeks to prohibit "direct or indirect discrimination, harassment and victimisation based on gender", and proposes to cover public bodies, employers and other persons.
It, however, stipulates that the special protection of women because of "pregnancy, childbirth and breastfeeding" shall not constitute gender discrimination.
Zarizana said the bill was drafted following the Beatrice Fernandez case where the former Malaysia Airlines System stewardess was dismissed following a pregnancy, and was unable to seek legal recourse despite the Federal Constitution's provision against gender discrimination, and Malaysia's 1995 ratification of the Convention on the Elimination of All Forms of Discrimination against Women (CEDAW).
The bill was drafted by Penang-based WCC and will be circulated to civil society for feedback before being submitted to the government next year (2007). "It will enable the government to implement CEDAW," Zarizana said.

sememangnya wujud perbezaan antara lelaki dan wanita baik dari segi mental emosi dan apatah lagi fizikal dan semunya tersirat kelebihan masing2, dan Allah telah memilih lelaki sebagai pemimpin akibat perbezaan tersebut (4:34). sestengah pihak SIS n sewaktu ngan nye ade jugak kecoh2 bg idea untuk biarkan WANITA JADI KETUA KELUARGA'to gain fairness n equality'. keadilan yg macam mane dorang nk ana pun confius.. penindasan yg macam mana dilakukan oleh suami2 mereka (klu la dorg ade suami)@ hak apa yg dirampas ana pon tk tahu..

myb they don't understand bout islam yet..they think that islam does not give equal rights yet to women...i have some info to be shared...bag akhirnya sy bertudung...mengikut cr islamic...dlm quran (24:31)...ini perintah tuhan...siapalah kite utk menyangkalnya...sy tulis nie krn teringat tudung dikatakan simbol penindasan oleh org barat....kenapa org barat memandang rendah dan mengetepikan Islam?..masy Barat mereka-reka imej org islam drpd pemikiran mrk sendiri...so, jgnlah kite pula terbawa-bawa atau terikut-ikut dgn cara org barat...right?..Lelaki dan wanita itu berlainan, dan lelaki dan wanita adalah sama daripada pandangan Islam..sbnrnya,bg Islam prinsip takrif kesetaraan adalah kedudukan manusia di sisi Tuhan. Al-quran dgn jelas menyatakan lelaki dan wanita sama di sisi Tuhan.Lelaki dan wanita dicipta daripada satu roh tunggal, dan kedua-duanya memegang amanah Tuhan di bumi (al-quran 2:30), msg2 bertanggungjawab terhadap tindakan sendiri. Tiada berbezaan ant lelaki dan wanita.
